Cop: 'First Amendment rights can be terminated'

The video is chilling, but it's also a sign of the times.

"Your First Amendment rights can be terminated," yells the Chicago police officer, caught on video right before arresting two journalists outside a Chicago hospital.? One, an NBC News photographer, was led away in handcuffs essentially for taking pictures in a public place.? He was released only minutes later, but the damage was done. Chicago cops suffered an embarrassing "caught on tape" moment, and civil rights experts who say cops are unfairly cracking down on citizens with cameras had their iconic moment.

Tales of reporters, protestors and citizen journalists being threatened or arrested for filming law enforcement officials during disputes are on the rise, critics say, with Occupy Wall Street protests a lightning rod for these incidents. The National Press Photographers Association claims it has documented 70 such arrests since September and, in May, called on U.S. Attorney General Eric Holder to focus attention on the issue.


"The First Amendment has come under assault on the streets of America," the photography association said in a letter to Holder that was also signed by several other interest groups. "Police have arrested dozens of journalists and activists simply for attempting to document political protests in public spaces.?

Such allegations are ironic, given the sharp rise in police surveillance technology, which gives cops vast capabilities to film citizens, said Catherine Crump, an American Civil Liberties Union attorney.

"It is true that Americans are photographed more and more today as they walk around in public spaces," Crump said. "And it is ironic that law enforcement agencies are objecting when the same activity is being used to film their activities. But it's not surprising because there's often a double-standard in this space."

There's always been a tense relationship between cops and cameras, but that relationship is being pushed to the brink now that half of U.S. adults carry smartphones, nearly all of them capable of filming and sharing visuals instantly with the whole world via the Internet.? Cops at Occupy Wall Street protests -- such as those at Zucotti Park in New York City -- routinely deal with dozens of amateur photographers shoving cameras in their faces, many of them aggressive.? It's not hard to see how the cameras can escalate an already tense situation.

But First Amendment law is clear: Citizens in public spaces have a right to film things they see in plain sight. Courts have repeatedly upheld that right in high-profile cases.

Court rulings sometimes have no bearing during intense situations, however.

"It wouldn't really matter with some police officers if you had an original copy of Bill of Rights with you," said Mickey Osterreicher, a lawyer for the press photographers association. He said he deals with new cases nearly every day involving photographers who he believes have been wrongly arrested.

"The sign on my desk that reads, 'Bang head here,' is getting worn out," he said.

In April, Connecticut's State Senate passed a law that clearly defined citizens' right to film, but the state's lower house failed to act on the measure. The proposal was introduced by Sen. Majority Leader Martin M. Looney , D-New Haven, after a series of incidents involving cops in that state's capital city. In one, a police officer is caught on camera saying ?You don?t take pictures of us,? before making an arrest. In another incident, 26-year-old Luis Luna was arrested for filming an arrest, and video files on his iPhone were deleted.

"In the past several years, police officers have wrongly arrested members of public for using video cameras or cell phone cameras," said Adam Joseph, a spokesman for Looney.? "In the opinion of a number of senators, there were far too many instances, and that demonstrated the right to videotape needed to be codified and is unfortunately necessary."?

The proliferation of devices that can film and share has made this conflict almost inevitable, but there are other causes, too.

?So many mainstream journalists have been laid off and are freelancing,? said Osterreicher, the press association lawyer. ?Then you have people who consider themselves citizen journalists. They have ?pro-sumer? devices capable of taking video and still images with the same quality as pro equipment, and can share them with the world, without mainstream media. That?s something we've never seen, until recently.?

'Threatening act'
As a result, civil liberties lawyers have beaten a path to courthouses around the country, said Crump.

"We do hear about these more frequently now because everyone walks around with cell phone cameras,? she said. ?Law enforcement officers sometimes react badly to this, and view it as a threatening act.?

The most celebrated case involves Simon Glik, who in 2007 filmed police arresting a homeless man near Boston Commons. Glick was arrested and charged with violating the state's wiretapping law.? His case was dismissed, but he then brought a federal civil rights lawsuit against the city. In August 2011, the First U.S. Circuit Court of Appeals for the First Circuit ruled unanimously in his favor.

"That decision is 24 pages of pure gold," Osterreicher said.? "The judges talked about the right to record in public. They said the First Amendment right is self-evident. They took judicial notice of the fact that news is as likely to come from someone with a cellphone as anyone. And they talked about the fact that police officers ? should expect to be recorded when out in public."

In March of this year, Boston paid Glik $170,000 to settle the suit.

"It's really not up to police officers to decide what is and isn't newsworthy," Osterreicher said. "It's a shame Boston had to learn an expensive lesson."

Other rulings have offered a similarly strong endorsement of the right to film, Crump said.

"The First Amendment is strongly protective of right to video and record in public spaces. There?s obviously a good reason for that. Sunlight is the best disinfectant," she said.? She said court rulings have been so consistent, she?s not worried about any weakening of the First Amendment ? ?but she is worried about the more practical side of the problem.? Glik's settlement -- most of which paid for his legal fees -- took five years to arrive.? In most real-life situations, police officers have wide discretion, and few observers have the time, money or wherewithal to see a First Amendment case through to completion.

Osterreicher, both a former journalist and a reserve police officer, prefers far more practical methods.? He travels the country training police officers in First Amendment law. Invited by Chicago police brass, he offered such training in advance of recent NATO meetings in Chicago, which attracted sizable protests.? He thinks it worked: To his knowledge, only one photographer was arrested during those protests.?

He also offers suggestions tips to would-be cop videographers.

"The First Amendment is not absolute," he said. "It is subject to reasonable time, place and manner restrictions. But the key word is ?reasonable.? Is it reasonable when covering a protest to ask someone to stand back or get on a sidewalk? Absolutely. Is it reasonable to expect the press to go away when there is an order to disperse? No."

One rule that is fairly absolute, he said: While there are situations when police can seize cameras and cellphones, they have no right to destroy data, such as pictures or videos, without consent from the owner.? In fact, doing so could be considered destruction of evidence.

The ACLU hosts an information page designed to help amateur photographers understand their rights on its website.? But Crump offered a thumbnail sketch of the law that draws an important distinction between public and private property.

"Generally, when you are in a public space where you have the right to be, you have right to photograph anything in plain view, and that includes police who are executing their duties,? she said. ?But if you are on private property, the property owner gets to set the rules.?

But Osterreicher said any advice photographers receive should come with a warning: ?"It's complicated."

"I can't give you an answer that covers all situations. You?re going to have to make an assessment,? he said ?Is this officer nonchalantly asking you to move? Or is he getting real cranky? A lot of situations can be defused with conversation. ? You want it to end well.?

Galactic slam: Milky Way to hit nearby galaxy ? in 4 billion years (+video)

The collision between the Milky Way and the nearby Andromeda galaxy will result in a single, enormous new elliptical galaxy, but not for another 6 billion years, researchers say.

In four billion years, the Andromeda Galaxy will plow through the Milky Way head on in a collision of cosmic proportions ? not once, not twice, but three times over about a 2 billion year span.

When cosmic do-si-do ends, the result will be an enormous elliptical galaxy that will alter a starry night sky in ways that would make Vincent van Gogh drop his brushes in awe (see video).

The edge-on view of the Milky Way now visible on a clear night under dark skies would first yield to a dazzling array of large, bright regions of star formation all across the sky. Ultimately, the sky would be dominated by a giant brightly glowing ellipse of stars ? the core of the new galaxy that our solar system would inhabit at a much greater distance from the center than it now does.

Those are the implications of study that for the first time firmly answers a question that has vexed astrophysicists for a century. Ever since the first measurements of the motions of galaxies were taken, the data showed that unlike virtually every other galaxy observed, Andromeda is heading toward the Milky Way, not away from it, as the universe expands. That led to the inevitable questions: Will Andromeda hit the Milky Way? And what will happen if it does?

Observations of other galaxy collisions over the past 100 years have allowed researchers to answer the second question before they had a clear answer to the first one. Now, a team led by Roeland van der Marel at the Space Telescope Science Institute in Baltimore reports that they've made the key, missing measurement ? Andromeda's sideways motion ? with enough confidence to call the head-on collision 4 billion years in advance.

The event ?will indeed be unprecedented? in the history of the two galaxies, notes Rosemary Wyse, a researcher who specializes in galaxy evolution at the Johns Hopkins University in Baltimore, who was not a member of the research team.

An old solution to a new problem

Andromeda, also known by its astronomical designation M31, is a Milky Way-size galaxy some 2.5 million light-years away. On a clear night under dark skies, its nucleus is visible to the naked eye as a small, glowing fuzz ball.

Using the Hubble Space Telescope, the team observed the galaxy's movement, using a technique that allowed stargazers in ancient civilizations to distinguish planets from stars in our own solar system. They measured the relative motion of objects in the foreground when seen against apparently fixed objects farther away.

During two observing campaigns in 2007 and 2009, the team gathered high-resolution images of stars in Andromeda's halo and looked for changes in their positions compared with galaxies so far away they they displayed no motion from one period to the next. The two galaxies are approaching each other at about 250,000 miles an hour. The team's measurements indicated that Andromeda was sidling sideways at between one-quarter to one-third of the two galaxies' closing speed, explains Dr. van der Marel.

The kicker: The closing speed increases with time because each galaxy's gravitational tug on the other grows stronger as they two draw closer. By the time of the first encounter about 4 billion years from now, the two will have reached a combined collision speed of roughly 1.25 million miles an hour. This means that an already small sideways motion, which doesn't change change with time, becomes increasingly insignificant compared with the rising collision speed.

95% Moonrise Kingdom

There's no denying the extravagant pleasures "Moonrise Kingdom" affords as an erudite wish-fulfillment fantasy of empowerment and autonomy.

If it's not as deft as his most adorable confections ("The Royal Tenenbaums," "The Fantastic Mr. Fox"), it's still got plenty to chew on and chuckle over for initiates in the Cult of Wes.

Last time out, in Fantastic Mr. Fox, Wes Anderson adapted a children's book by Roald Dahl. Now, in Moonrise Kingdom, he's made one of his own.

It's an adventure, a love story, a biblical allegory complete with approaching storm, a mash note to composer Benjamin Britten and a profoundly touching discourse on the needs of troubled children.

"Moonrise Kingdom" is Anderson's seventh movie, and it's the first since "Rushmore" that works from the opening shot to the final image.

It's a fable about what it feels like to be 12 years old and afflicted, from head to toe, by a romantic crush the size of a planet.

Moonrise Kingdom might be Wes Anderson's purest work yet -- a tender tale of longing and melancholy as seen through the eyes of a handful of people on an isolated (fictional) island off the coast of New England.

Anderson's most involving and sardonically funny movie since Rushmore (and maybe better).

Another great film from Anderson, and the beginning of a fantastic career for Hayward.

The adventurous circumstances and sensations of young love permeate Moonrise Kingdom.

It's the filmmaker's best piece of live-action cinematic art since 'Rushmore' and nicely joins 'Fantastic Mr. Fox' in his return to fine form. (Full Content Review for Parents also available)

Moonrise Kingdom feels like a culmination, like Anderson has been working towards this one movie.

Wes Anderson films are not so much directed as curated.

Funny and heartfelt in equal measure, "Moonrise Kingdom" is a top-to-bottom charmer and one of the most heartfelt peans to the power of young love that you will see anytime soon.

Has individual moments that are alluring to the eyes, but like the aforementioned dollhouse where Suzy lives, take a closer look inside and it becomes obvious how artificial all the parts are.

Who else can capture with such chilling accuracy that fragile period between childhood and disillusionment, the time when the novelty of true love overwhelms the heart with its immensity and futility?

If you can meet with realism and surrealism and treat those two impostors just the same, then yours are the movies and everything in them. I'm paraphrasing Emilio Estevez but I think you get the idea.

A true delight - a fun, clever, and, of course, whimsical tale about the days when love seemed worth running away from home over and getting a scout badge meant the world.

Anderson's most delightfully bittersweet live-action movie since The Royal Tenenbaums.

Investing in Japan: Is There Light at the End of the Tunnel? - Money ...

The reality is that Japanese and German products and services are highly competitive, both in advanced economies and in emerging markets. Conversely, U.S. exports are not as competitive except in a few sectors.

Even so, the Japanese stock market is still trading at less than a third of its 1990 peak.

However, that's no longer something to sneer at since the S&P 500 is also trading well below its 2000 peak.

The reality is that speculative bubbles such as that in Japanese stocks and real estate in the 1980s and U.S. stocks in the 1990s and housing in the 2000s are enormously damaging. The after-effects can last for years, or even decades.

Truly Alan Greenspan, Ben Bernanke and their 1980s Japanese counterparts have a lot to answer for.

These quasi-politicians at central banks should not be allowed to play games with the money supply. Rather, they ought to adopt an automatic system such as a gold standard.

Of course, it's all very well quoting the superior returns over the long term from equity investments. But the truth is, we have finite lifespans.

An investment in the U.S that loses money for 12 years and counting -- or 22 years and counting in Japan -- is not very attractive as a means of saving for retirement (unless you're 25).

Nevertheless, while the tunnel may be a long one, it is not an infinite one. Today in Japan there are signs we may be emerging from the other end.

Robust growth is the means by which both Japan and eventually the U.S. will emerge, which will reduce the excessive debt levels in the system and allow equity and other asset values to start increasing again.

Naturally, the politicians have to stop running huge deficits in order for this to happen, but in Japan this may finally be happening, with the government proposing to double the consumption tax to 10% in two stages by 2015.

Two Ways to Invest in Japan

Since Japan's export sector is hampered by its high exchange rate, the best Japanese investment would focus on the smaller companies. Such companies benefit from domestic growth and are themselves suppliers to the export giants.

The SPDR Russell/Nomura Japan smaller companies ETF (NYSE: JSC), for example, has now been running since 2006 and has an expense ratio of a modest 0.56%. It looks to be an excellent way to tap into Japanese small company growth.

Alternatively, you should consider investing in the Japanese financial sector, which has major growth opportunities in Asia and has avoided many of the problems of the 2008 meltdown.

In this area the best-capitalized company is Orix Corporation (NYSE: IX).

Orix, originally a leasing specialist, has expanded into most sectors of commercial and investment banking, with an emphasis on investment rather than trading. It has capital of around 15% of assets -- nearly double the capitalization ratio of most banks, in Japan or elsewhere.

What's more, Orix is trading on a P/E ratio of around 10 and at 53% of book value. For Japanese-minded investors it's also a bargain.

After a long downturn, Japan is poised to rebound. The conventional wisdom, as is often the case, is wrong.
